  • When should I make or update my Will?

You should make or update your Will when your relationship circumstances change; your financial circumstances change; you have a child; you have another child; your executor dies or no longer wishes to act as executor; a beneficiary dies; you dispose of property or other assets.

  • When should I update my succession plan?

It's sensible to make or update your estate plan if you own, sell or purchase residential property; own, sell or purchase commercial property or a business enterprise; have children; have recently been married; are considering divorce or have recently been divorced; wish to make a special bequest to a friend or relative in your Will; are of ill health; have realised wealth through an inheritance.

  • Should the property be held in people's names as joint tenants or tenants in common?

A good example for purchasing property as tenants in common would be a couple buying a house when both have children from previous marriages. This would be a perfect example where the property should be owned as tenants in common in equal shares (50/50) and deal with their half share of their property in their Will. In a joint pennant situation, a couple would buy real estate as joint tenants. This would mean that upon the passing of one person the surviving person would inherit the asset.
